Student Photo Gallery Terms and Conditions

Before uploading any photo to our site, please carefully read the following terms and conditions of use. Uploading any photograph onto this website constitutes your acceptance of the terms and conditions of use outlined herein. 

 

Purpose and Intentions

Our website gallery is intended for our registered students use only. The iPhotography gallery is designed to provide a private viewing area for students to upload and share their own photographs. It is intended to engage interest and encourage positive and constructive feedback for students on their recent photos. We reserve the right to reject any images or comments that we feel are unsuitable, inappropriate, obscene, substandard, deemed offensive or an infringement upon copyright.

The iPhotography gallery cannot guarantee preservation of uploaded images for any length of time. We recommend all users keep a backup of upload content elsewhere in case of server failure or technical issues.

The gallery is not a space for users to permanently keep their photos or use as online storage. Images uploaded to the gallery will only be kept on our servers for 12 months. After this time images will be removed. 

 

Public Viewing and Permitting of Limited Rights

By uploading an image to our site, you are granting us a license to use and display the image in any size or format and on any pages deemed suitable. Please be aware that your photo may be displayed within our public gallery, on various pages on our site, within promotional materials and maybe also be displayed with iPhotography social networking sites. Selected student images may also be used on iPhotography third-party partner websites for promotion of our courses, brand or products. Student images will be credited, if possible.

By uploading photographs to the gallery you are agreeing to these terms of use. If you have any queries or concerns regarding the above, please contact [email protected] before uploading your image.

 

Copyright

You must own the copyright of the image you upload. Uploaded photographs must be owned and submitted by the original photographer and sole owner of the copyright. Copyright of the uploaded image remains the property of the student photographer. Do not submit any photographs taken by anyone other than yourself or your account access will instantly be blocked and you may be liable to prosecution. By submitting your photograph you are guaranteeing that you are the photographer and copyright holder for the image and accept responsibility for ownership.

By uploading an image to our website you are agreeing to indemnify us from any liability resulting from breaches of copyright (or model release) of the image existing online on our website in digital form. iphotography.com will not be held responsible or liable for loss; claim, damages and expenses that occurred in connection with or associated with the uploading of any photograph.

As photographers ourselves, we respect your image copyright and ask that you respect the copyright of your fellow students, course tutors and course providers. You may not copy or distribute any photographs or written content from within iPhotography without prior consent and written authorisation from parent company V-Learn.

Please note: anyone seen to be abusing or breaking copyright infringement, using other students’ images or using our trademark name (without written permission) will have their account immediately closed (and also risks legal prosecution). Model and Property Release

You acknowledge and confirm that you have sufficient written permission (if necessary) to upload any image to our website that contains recognisable people, property or locations. By uploading the image you are granting permission and acceptance of our use of the image (as set out in our terms). You accept all liability for uploading the image and confirm that you have consent to upload, display, publish and share this image with iPhotography.

Please note: In addition to this, if your image contains anyone under the age of 18, you must have agreed with consent from the parent or guardian before uploading.

 

Acceptance of Terms and Conditions

By uploading a photograph to our site, you indicate that you accept these terms and that you agree to be bound by them. Acceptance of these terms creates a binding contract between you and iphotography.com that you will use the service only in a manner consistent with these terms. These terms may be changed or updated at any time, but you can always find the most recent version here. You should periodically check this page to make sure you are up to date.

If you have questions about these terms, please contact [email protected]. Your use of the gallery and site upload services is entirely conditioned on and subject to your compliance with these terms. If you do not agree with these terms, do not upload, access or use the service.

If you submit an image in error or have accidentally breached these terms in any way, please contact [email protected] immediately.

If you notice that these terms are being breached by others within (or outside) of the course, please detail and report the abuse of these terms to [email protected]. Thank you for your cooperation, support and assistance.

 

Copyright Infringements / Composites

When uploading photographs to the iPhotography feedback gallery all images uploaded by students must 100% belong to that user. Students that are found to have uploaded an image(s) that do not belong to them 100% will have that image(s) removed and their account may be suspended from iPhotography. This includes reposting images owned by other gallery users without their expressed permission.

Composite photographs are allowed in the gallery, providing that any/all elements are either;

  1. 100% owned by the posting photographer.
  2. using images from copyright-free / royalty-free stock photo websites, or suitable rights have been purchased with proof.
  3. Any attribution/credit is given in the title/description of the posted image(s) where asked for by the original photographer/artist. 

Images used for composites which have come from stock photo websites should only form part of the overall final composite. It should not be a straight replication/repost or more than 50% of the final composites artistic look.

Any photographs found breaking any of the aforementioned rules will be removed from the gallery and the user account may be indefinitely revoked from using the feedback gallery, subscription platforms (iPhotography PLUS), if relevant, and iPhotography courses.

We take copyright infringement extremely seriously for the protection of the gallery’s integrity and the protection of other photographers’ work.

 

Rights and Usage

Any images uploaded to the iPhotography Feedback Gallery may be used by iPhotography for purposes of promotion or advertising without prior consent. If possible, iPhotography will credit the original photographer on publication. Please do not post images to the Feedback Gallery if you do not agree with these terms.

The original photographer retains full ownership of their intellectual property.

 

Use of AI-Generated Imagery / Assets

As the use of AI-generated imagery and assets rises we ask that ANY gallery upload, that has used AI generation technology to either fully or partially create the final upload, is labelled as such either in the upload’s title or description field. Failure to do so may result in an account being restricted from using the gallery.

We are happy to see small uses of AI assisting tools in the instance of improving the image, for example, sky replacements, skin retouching and content-aware removal etc.

We actively discourage images that are fully (or over 50%) generated using AI-generated imagery platforms/tools such as Photoshop Generative Fill, Mid Journey, DALL-E2, Bing Image Creator, Canva Text-to-Image, Dream by Wombo, Craiyon, Night Cafe etc from being uploaded to the iPhotography gallery.

Uploading images that are generated using these AI tools be taken into consideration for POTD, Weekend Challenge and other gallery-based competitions. The overall decision to remove images from the gallery based on the use of AI lies with the iPhotography tutor team and parent company V-Learn. Users may not be notified of an image deletion.

 

Behaviour & Comments

The iPhotography gallery is a space for new and experienced photographers to share photographs with like minded people. The use of comments in the gallery is to aid with image feedback, suggestions and general communication with a specific user. Comments should not be unhelpful, rude,  hateful or spam. Any accounts found to be breaching this purpose may be restricted from using the gallery or their account removed permanently.

All display names in the gallery must be displayed as the accurate name of the actual account holder. Pseudonyms, nicknames and alias’ are not allowed. Full names must be shown and not just usernames, surnames, or first names.
